Standard Terms and Conditions

ORDER TERMS AND CONDITIONS

We aim to make doing business as simple as possible. No hidden agendas, fine print or catches. However, it is important to ensure all parties are aware of our policies. By purchasing products or services from Southern Broadcast Ltd the customer hereby agrees to the following terms and conditions;

PAYMENT

Orders must be paid for in full before dispatch unless a credit account exists.

Orders placed on credit account are due on the 20th of the month following Invoice date.

Quote pricing is only valid for 30 days due to the potential for pricing amendments from Southern Broadcast’s Suppliers.

Quote or Order pricing is based on exchange rates on the day. Since most of Southern Broadcast’s international suppliers operate in foreign currencies any large orders or those with long lead times will be subject to additional charges resulting from exchange rate variations.

Some large or custom orders require deposits. The deposit amount and payable date will be determined on a per-order basis as it is often set by Southern Broadcast Ltd’s suppliers.

Goods remain the property of Southern Broadcast Ltd until paid for in full.

Overdue accounts referred to a collection agency and/or law firm, will be liable for all collection costs incurred, these costs will be added to the amount(s) that are overdue, including commission on collection of the additional costs, including any legal costs.

Overdue accounts will be subject to interest at the rate of 13% p.a., calculated for the period the account is due (date of due payment of invoice) until the date it is paid.

DELIVERY / LEAD TIMES

Domestic New Zealand deliveries are made by the most cost effective courier optio, Southe Broadcast has arrangements with most of New Zealand’s leading courier firms.

International deliveries are made by DHL Express.

Shipments of all customer orders include insurance for loss or damage.

Lead times for orders fulfilled from stock at Southern Broadcast Ltd’s Auckland warehouse are dependent on the customer’s location and time of order. Normal transit times are next day for North Island and 2 days for South Island. Transit times for international orders must be confirmed at time of order.

Orders for items not in stock will be confirmed after discussion with the relevant manufacturer and are dependent on their stock level and production schedule. Please indicate at time of order if products are required urgently so that they may be prioritised.

DEMONSTRATION EQUIPMENT

Southern Broadcast Ltd keeps stock of equipment for the purpose of customer evaluation. This equipment is provided free of charge. Customers are expected to take care of demonstration equipment in order to minimise damage. Any repairs needed as a result of misuse are at the customer’s expense. If equipment is not returned for any reason payment in full is required.

RETURNS

Equipment purchased in error may be returned for refund only if in new condition and with original packaging. A restocking fee of 15% is required but may be waived if another item is purchased.

Purchases of custom or ‘special order’ items may only be returned if approved by the manufacturer. Associated charges such as manufacturer restocking fees and shipment expenses are at the customer’s cost.

EQUIPMENT WARRANTY

All equipment sold is procured through official distribution channels and therefore is supplied with full manufacturer warranty. The length of warranty is set by the manufacturer but is not less than 1 year.

Manufacturer warranty conditions are usually RTB (return to base). If Southern Broadcast Ltd is unable to repair faulty equipment in warranty the cost of returning the equipment to the manufacturer will be borne by the customer.

Diagnosis or repair of faulty equipment that is damaged by misuse or force majeure is at the customer’s cost.

Diagnosis or repair of faulty equipment that is out of manufacturer warranty is at the customer’s cost.

LIMITED LIABILTY

Southern Broadcast Ltd accepts no liability for consequential damages caused by failure of any equipment or services provided. It is the customers’ liability to ensure that appropriate measures are undertaken to ensure service outages do not occur as a result of product failure.

Southern Broadcast Ltd can provide advice on the best way to minimise the risk of service outages.

PRIVACY POLICY

Southern Broadcast respects our customer’s privacy and takes active steps to ensure any data is kept safe. Any and all information collected from customers by Southern Broadcast Ltd will be kept strictly confidential. At no time whatsoever will information be sold, reused, or disclosed to third parties. The only exception is communicating customer purchases with suppliers for the purpose of warranty validation. Please request if you do not wish Southern Broadcast Ltd to share information of equipment purchased with relevant manufacturers.

We will only release account and other personal information if we believe release is required by law; I.E. to facilitate court proceedings; enforce or apply our terms and conditions; or protect the rights, property, or safety of Southern Broadcast Ltd and our customers.
